Terms of Service

Effective and last updated: September 12, 2026

These Terms of Service (“Terms”) govern your access to nestnotary.com (the “Site”) and your request, booking, purchase, or use of services offered by Nest Notary (“Nest Notary,” “we,” “us,” or “our”).

By accessing the Site, submitting an inquiry or service request, booking an appointment, approving a quote, making a payment, or receiving services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or request services.

1. Services

  • Mobile notary appointments

  • Remote online notarization

  • Apostille and authentication facilitation

  • Loan-signing services

  • Estate-planning document notarization

  • Business and corporate notarization

  • Real-estate document notarization

  • Personal document notarization

  • Hospital and healthcare-facility appointments

  • Legal document courier and delivery

  • Printing and scanning

  • Witness coordination

  • Certified-copy procurement assistance

  • Third-party document translation coordination

  • Other related document-support services

Service availability depends on the document, location, requested date, number of signers, identification, witnesses, receiving-party requirements, governmental requirements, platform availability, and other circumstances affecting the request.

Submitting a request does not guarantee that Nest Notary will accept or complete the service. A service is accepted only after we review the request and issue a booking confirmation, written acceptance, or invoice.

2. No Legal, Tax, Financial, or Immigration Advice

Nest Notary is not a law firm and does not provide legal, tax, financial, immigration, or other professional advice.

A notary public is not permitted to:

  • Draft legal documents unless separately licensed or authorized

  • Select a document for a client

  • Choose the notarial certificate or notarial act for a client

  • Interpret the legal effect of a document

  • Advise a signer whether to sign

  • Explain substantive loan, estate-planning, business, immigration, or real-estate terms

You are responsible for obtaining advice from a qualified attorney or other licensed professional when needed.

No attorney-client, fiduciary, financial-adviser, tax-adviser, or similar professional relationship is created through your use of the Site or services.

3. Client Responsibilities

You are responsible for:

  • Providing complete and accurate information

  • Presenting the correct document

  • Ensuring the document is complete and ready for the requested service

  • Obtaining legal or professional advice when needed

  • Determining the appropriate notarial act or certificate with the document preparer or receiving party

  • Confirming that the receiving person, agency, court, lender, title company, country, or organization will accept the completed document

  • Providing acceptable identification

  • Ensuring all required signers and witnesses are present and eligible

  • Providing accurate pickup, delivery, mailing, and recipient information

  • Meeting deadlines imposed by courts, government offices, lenders, employers, schools, foreign authorities, or other third parties

  • Reviewing names, dates, addresses, identification numbers, and other important information for accuracy

Nest Notary may provide general procedural information but does not determine the legal sufficiency, validity, enforceability, or effect of a document.

4. Notary Appointments

A notarization may be refused or discontinued when:

  • The signer is not present as required

  • Acceptable identification is not provided

  • The signer does not appear willing, aware, or able to communicate directly with the notary

  • The document contains material blanks

  • The requested act is prohibited or cannot lawfully be completed

  • The notarial certificate is missing and the signer has not received direction from an authorized person

  • The notary reasonably suspects fraud, coercion, misrepresentation, illegality, or an unsafe situation

  • A required witness is unavailable or ineligible

  • The document or transaction does not meet applicable requirements

  • Completing the request would violate law, professional duties, platform rules, or Nest Notary policy

Payment for travel, waiting time, printing, witnesses, expedited scheduling, or other services may still be due when an appointment cannot be completed because the client or signer did not satisfy the disclosed requirements.

After-hours in-person appointments are currently offered only for eligible service locations within the Dallas–Fort Worth Metroplex. All after-hours requests remain subject to service-area eligibility, availability, safety considerations, and written confirmation by Nest Notary.

5. Remote Online Notarization

Remote online notarization is available only for eligible documents and transactions.

The signer may be required to:

  • Use a compatible device with a working camera and microphone

  • Maintain a reliable internet connection

  • Present acceptable identification

  • Complete credential analysis

  • Complete knowledge-based authentication or another identity-proofing procedure

  • Participate in a live audio-video session

  • Electronically sign the document

  • Consent to legally required records, journal entries, audit trails, or audio-video recording

A remote session may be refused or terminated if identity verification fails, the connection is inadequate, the signer cannot communicate directly with the notary, the document is ineligible, or the circumstances do not satisfy applicable requirements.

Nest Notary does not guarantee that a receiving party will accept a remotely notarized electronic document. You must confirm acceptance before booking.

6. Apostille and Authentication Services

Nest Notary facilitates and coordinates apostille, authentication, legalization, certified-copy, notarization, submission, tracking, shipping, and related document services.

Nest Notary does not issue apostilles or governmental authentications. The applicable Secretary of State, federal agency, embassy, consulate, court, county office, records office, educational institution, or other authority determines eligibility and issues or rejects the requested certification.

Unless expressly stated otherwise in writing, quoted processing periods begin only after Nest Notary has physically received all complete original or certified documents required for the order and confirmed that the request is approved, paid, and ready for processing. Preliminary review of an uploaded copy, submission of a request, approval of a quote, payment, or placement of documents in transit does not by itself begin the processing period. Shipping or delivery time to Nest Notary is not included.

Processing times are estimates, not guarantees. Government closures, holidays, backlogs, policy changes, document defects, shipping delays, receiving-country requirements, and other circumstances may affect completion.

You are responsible for accurately identifying:

  • The country where the document will be used

  • The document’s issuing state or authority

  • The purpose for which it will be used

  • The deadline

  • Any instructions provided by the foreign recipient

Nest Notary may recommend additional steps based on the information provided, but the receiving authority makes the final acceptance decision.

Government, embassy, consular, courier, shipping, records, certified-copy, translation, and other third-party fees are nonrefundable once incurred.

7. Loan-Signing Services

Nest Notary may present loan documents according to instructions supplied by the lender, title company, escrow company, signing service, or other hiring party.

Nest Notary does not:

  • Explain or interpret loan terms

  • Negotiate rates, fees, or conditions

  • Provide lending, title, real-estate, or legal advice

  • Modify documents without authorization

  • Guarantee that a loan will fund, record, or close

Questions concerning the substance of a loan or transaction must be directed to the lender, title company, escrow officer, attorney, or other authorized representative.

8. Translation Coordination

Translation services may be performed by an independent third-party translator or translation provider coordinated by Nest Notary.

Translation and notarization are separate services. A notarization does not certify that a translation is accurate unless a qualified person executes an appropriate translator’s declaration and the requested notarial act is performed on that declaration.

You are responsible for reviewing names, dates, numbers, addresses, technical terms, and other critical information. Acceptance of a translation is determined by the receiving organization.

Nest Notary does not guarantee that a court, agency, educational institution, embassy, consulate, immigration authority, employer, or other recipient will accept a particular translation format or certification.

9. Courier and Document-Delivery Services

Nest Notary provides document pickup and delivery according to the information and instructions supplied by the client.

Nest Notary is not a process server and does not provide formal service of process unless separately authorized and expressly agreed in writing.

You are responsible for:

  • Providing accurate pickup and delivery addresses

  • Providing accurate contact and recipient information

  • Properly identifying and packaging the documents

  • Disclosing deadlines and special handling requirements

  • Obtaining permission to release documents to the identified recipient

Delivery times are estimates unless Nest Notary expressly accepts a guaranteed deadline in writing. Weather, traffic, building access, recipient availability, government-office procedures, emergencies, and other circumstances may cause delays.

10. Pricing and Quotes

Prices displayed on the Site are starting prices unless expressly identified as fixed.

The final amount may depend on:

  • Travel distance

  • Number of documents

  • Number of notarizations

  • Number of signers

  • Number of signatures

  • Witness requirements

  • Printing or scanning

  • Document size and page count

  • Appointment time

  • Same-day, urgent, weekend, holiday, or after-hours service

  • Waiting time

  • Government and third-party fees

  • Courier or shipping charges

  • Certified-copy requirements

  • Translation length and language

  • Additional stops or return trips

  • Other requirements disclosed during review

A quote is based on the information available when issued. If the request changes or the information provided was incomplete, Nest Notary may revise the quote before completing the additional work.

11. Payment

Payment may be required in full or in part before an appointment, submission, document order, third-party engagement, or other service begins.

By providing a payment method, you authorize the applicable charge for the services, fees, taxes, and approved expenses associated with your request.

Amounts paid for completed work, travel already begun, printing, government filings, certified copies, shipping, translation, platform charges, witnesses, courier assignments, or other incurred third-party expenses are nonrefundable except where required by law.

If you believe a charge is incorrect, contact Nest Notary promptly at info@nestnotary.com so the matter can be reviewed. Nothing in these Terms limits rights that cannot lawfully be waived.

12. Cancellations, Rescheduling, and Unsuccessful Appointments

Cancellation and rescheduling terms displayed during booking, provided in a quote, or included in a confirmation are incorporated into these Terms.

Refund eligibility depends on:

  • When the cancellation is received

  • Whether travel has begun

  • Whether appointment time was reserved

  • Whether documents were reviewed or printed

  • Whether third-party, government, witness, platform, courier, translation, shipping, or records fees were incurred

  • Whether expedited work has begun

An appointment may be treated as unsuccessful when a signer is unavailable, lacks acceptable identification, is unwilling or unable to proceed, is not sufficiently aware to communicate, has signed prematurely when personal appearance was required, presents an incomplete document, lacks required witnesses, or otherwise cannot complete the requested service.

13. Waiting Time and Delays

Clients should ensure that signers, identification, witnesses, documents, facility access, parking instructions, and onsite contacts are ready at the scheduled time.

Additional charges may apply for waiting time, extended appointments, repeated travel, return visits, or delays outside Nest Notary’s control when those charges are disclosed before they are incurred.

14. Third-Party Providers

Nest Notary may use or coordinate with third parties, including:

  • Wix and website-service providers

  • Booking and payment processors

  • Remote-online-notarization platforms

  • Identity-proofing and credential-analysis providers

  • Translators and interpreters

  • Couriers and shipping carriers

  • Records and certified-copy providers

  • Government offices

  • Embassies and consulates

  • Printing, scanning, storage, communications, and technology providers

Third parties may impose separate terms, privacy notices, eligibility rules, processing times, and fees. Nest Notary is not responsible for a third party’s independent systems, decisions, interruptions, delays, acts, omissions, or acceptance requirements except to the extent responsibility cannot lawfully be excluded.

15. Communications

By submitting contact information in connection with an inquiry, booking, payment, or service, you authorize Nest Notary to contact you regarding that matter by telephone, email, or text message.

Service-related communications may include appointment confirmations, document questions, payment notices, status updates, delivery updates, security notices, and follow-up information.

Consent to receive marketing messages is not required to purchase services. Marketing communications, if offered, will include a method to opt out as required by law.

Message and data rates may apply.

16. Electronic Records and Signatures

You agree that electronic communications, confirmations, disclosures, invoices, approvals, signatures, and records may satisfy legal requirements that information be provided in writing, where permitted by law.

You are responsible for maintaining accurate contact information and reviewing communications associated with your request.

17. Website Use

You may use the Site only for lawful purposes.

You may not:

  • Submit false, fraudulent, misleading, or unauthorized information

  • Upload malicious code or interfere with Site security

  • Attempt unauthorized access to accounts, systems, records, or data

  • Impersonate another person or misrepresent your authority

  • Use the Site to facilitate fraud or unlawful activity

  • Copy, scrape, reproduce, or commercially exploit Site content without permission

  • Submit documents or personal information you are not authorized to provide

Nest Notary may restrict or terminate access when misuse is suspected.

18. Intellectual Property

The Site and its original text, branding, graphics, design elements, service descriptions, logos, and other content are owned by or licensed to Nest Notary and are protected by applicable intellectual-property laws.

You may view and use the Site for personal or internal business purposes connected to evaluating or purchasing Nest Notary services. No other license is granted.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and services are provided on an “as available” basis.

Nest Notary does not guarantee:

  • Uninterrupted Site, platform, or third-party availability

  • Government approval

  • Acceptance by a receiving party

  • Completion by an estimated deadline

  • A particular legal, financial, immigration, business, real-estate, loan, or personal outcome

  • That every document or transaction is eligible for the requested service

  • That a third-party carrier, government office, platform, translator, or provider will perform without delay or error

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

20. Limitation of Liability

To the fullest extent permitted by law, Nest Notary will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, missed deadlines, financing decisions, recording delays, government decisions, recipient rejection, or third-party service failures arising from the Site or services.

To the fullest extent permitted by law, Nest Notary’s total liability arising from a particular service will not exceed the amount paid directly to Nest Notary for that service.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability resulting from fraud, willful misconduct, or gross negligence where applicable law prohibits limitation.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nest Notary and its owners, personnel, contractors, and service providers from third-party claims, losses, liabilities, damages, and reasonable costs arising from:

  • Information or instructions you supplied

  • Documents or personal information you were not authorized to provide

  • Your misuse of the Site or services

  • Your violation of these Terms

  • Your violation of another person’s rights

  • Fraudulent, unlawful, misleading, or unauthorized conduct connected to your request

This section does not require indemnification for conduct that cannot lawfully be indemnified.

22. Events Outside Our Control

Nest Notary is not responsible for delay or nonperformance caused by circumstances outside reasonable control, including severe weather, traffic emergencies, illness, power or internet failure, government closure, governmental backlog, carrier disruption, platform outage, labor dispute, public emergency, natural disaster, civil disturbance, war, terrorism, or changes in law or governmental procedure.

23. Privacy

Our collection and handling of personal information are governed by the Nest Notary Privacy Policy.

Additional third-party privacy notices may apply to payments, remote notarization, identity verification, shipping, translation, bookings, and other services.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute that is not resolved informally and is properly brought in court must be filed in a court of competent jurisdiction located in Dallas County, Texas, unless applicable law requires another location.

Before filing a claim, the parties are encouraged to provide written notice and make a good-faith effort to resolve the dispute.

25. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Failure to enforce a provision does not waive the right to enforce it later.

26. Changes to These Terms

Nest Notary may update these Terms to reflect changes in services, law, technology, or business practices.

The updated version will be posted on the Site with a revised effective date. Changes apply prospectively unless otherwise stated or required by law.
