What Is Estate Planning Document Notarization?
Estate planning document notarization is the process of verifying a signer’s identity and completing the required notarial act for documents concerning their personal, financial, medical, or property-related wishes.
Depending on the document, the notary may take an acknowledgment, administer an oath or affirmation, or witness a signature. Some estate-planning documents may also require one or more independent witnesses.
Nest Notary carefully coordinates the signing requirements provided by you or your attorney while maintaining professionalism, patience, and respect for the sensitive nature of the appointment.

Frequently Asked Questions (FAQ)
What estate-planning documents can Nest Notary assist with?
Nest Notary assists with powers of attorney, advance directives, trust documents, self-proving affidavits, deeds, guardianship-related documents, and other prepared estate-planning documents requiring notarization.
Can you prepare my estate-planning documents?
No. A notary cannot draft legal documents or provide legal advice unless separately licensed or authorized to do so. Your documents should be prepared by you, your attorney, or an authorized document provider.
Should the documents be signed before the appointment?
Please do not sign any signature that must be witnessed or notarized before meeting with the notary. Other sections should generally be completed beforehand without leaving blanks that could affect the document.
What identification will the signer need?
The signer generally needs a current government-issued photo ID, such as a driver’s license, state identification card, or passport. Contact Nest Notary beforehand if the signer does not have standard identification.
Can you notarize documents at hospitals and care facilities?
Yes. Nest Notary offers appointments at hospitals, nursing homes, assisted-living communities, rehabilitation facilities, and hospice locations throughout the service area.
Can you provide witnesses?
Witness coordination may be available when requested in advance. Additional fees may apply based on the number of witnesses, location, and appointment time.
Who qualifies as a witness?
Witness qualifications depend on the document. Some documents may require witnesses who are adults, mentally competent, disinterested in the transaction, and not related to or entitled to inherit from the signer. Confirm the requirements with your attorney or document preparer.
Can you notarize a will?
Certain signatures or accompanying affidavits within an estate-planning package may require notarization. In Texas, a will’s self-proving affidavit is commonly notarized. The document preparer or attorney should identify the exact signatures and certificates requiring notarization.
Can you notarize a power of attorney?
Yes, properly prepared powers of attorney are commonly notarized. The signer must personally appear, provide acceptable identification, and demonstrate willingness and awareness at the appointment.
What if the signer has difficulty communicating?
The signer must be able to communicate directly with the notary and demonstrate that they understand the general nature of the document and are signing willingly. An interpreter or other accommodation may be considered when legally appropriate and arranged beforehand.
What if the signer has dementia or diminished capacity?
A diagnosis alone does not automatically determine whether a notarization can proceed. The notary must make an independent assessment at the appointment. If the signer cannot demonstrate awareness or willingness, the notarization will not be completed.
Can a family member answer questions for the signer?
Family members may assist with logistical matters, but the signer must communicate their own willingness and awareness directly to the notary. The notary may ask to speak with the signer privately.
Can you notarize documents if the signer is physically unable to sign normally?
Texas law may permit certain alternative signing procedures in limited circumstances. Please explain the situation before scheduling so the applicable requirements can be reviewed.
Can several estate-planning documents be completed during one appointment?
Yes. Please provide the approximate number of documents, signatures, notarizations, and witnesses when scheduling so enough time can be reserved.
Can you print the documents?
Yes. Printing may be arranged before the appointment. Please provide the file, total page count, number of copies, and any special printing instructions.
Do you offer same-day or urgent appointments?
Same-day, expedited, evening, and weekend appointments may be available based on location, witness requirements, and scheduling. Additional service fees may apply.
After-hours mobile appointments are currently limited to eligible locations within the DFW Metroplex.
How much does an estate-planning appointment cost?
Pricing depends on the number of notarizations, signers, witnesses, travel distance, appointment time, and any additional services such as printing, scanning, or delivery. An estimated total will be provided before confirmation.
